These General Contractual Conditions govern the purchase of products through the Website www.henryarroway.com, which is owned by the company INTERNACIONAL COMERCIO TRADING, S.L. By accepting these General Contractual Conditions, the user declares:

- That they assume all obligations set forth herein.
- That they are of legal age (18 years old) to access this Website, as well as to purchase the products offered on it.
We ask that you carefully read these Terms and Conditions, our Cookie Policy, and our Privacy Policy before using this Website. By using our Website or placing an order through it, you consent to be bound by these Conditions and by our Data Protection Policies.

Access to this Website implies the unreserved acceptance of these conditions of use that regulate the access and use thereof in order to make information about our products and services available to users.

Placing an order
The procedure for contracting the products offered through the Website is as follows:
- Selecting the product: The customer who wishes to purchase a product offered through our Website should go to our menu (WOMEN/MEN) and then select the desired category (down jackets, parkas, trench coats, etc.). To view the product and access its details, click on it. After selecting the desired garment, color, and size, click the ADD TO BASKET button. The Customer may continue selecting other products they want through the Website or proceed directly to place the order.
- Selecting the product: The customer who wishes to purchase a product offered through our Website should go to our menu (WOMEN/MEN) and then select the desired category (down jackets, parkas, trench coats, etc.). The Customer may continue selecting other products they want through the Website or proceed directly to place the order.
- Registration: It’s time to register. If you have registered previously, go to the ACCESS MY ACCOUNT section. If you do not remember your password, you can request a new one by clicking on Did you forget your password? and our team will send you a provisional password that you can change later from your personal area. If you do not yet have an account on henryarroway.com, go to CREATE AN ACCOUNT and enter the requested data.
- Delivery details: Next, the Customer must verify and fill in the billing information related to the order (name and surname, address, city, state/province, postal code, country, telephone, etc.). The Customer who has already registered their shipping details at an earlier time will not have to fill out this information again. Once this information is completed, click on CONTINUE TO PAYMENT/BUY.
- Shipping method: This screen provides information on the shipping method and costs.
- Payment information: The Website offers the Customer the option to choose between different payment methods: credit card, VISA, MasterCard, as well as 4B or 4B Maestro debit card (which implies an automatic charge), PayPal, Payment in Installments with Sequra, and Bizum.
You must notify INTERNACIONAL COMERCIO TRADING, S.L, of any undue or fraudulent charge on the card used for purchases, by email or telephone, as soon as possible so that INTERNACIONAL COMERCIO TRADING, S.L can carry out the appropriate steps. Additionally, payment method providers or issuers may adopt anti-fraud measures, which involve rejecting certain types of operations. INTERNACIONAL COMERCIO TRADING, S.L. is not responsible for the application of this type of security policies.
- Order confirmation: Once the order is confirmed, the Customer is shown confirmation of receipt of the order. The order will be processed once INTERNACIONAL COMERCIO TRADING, S.L receives confirmation of payment for the order according to the method chosen by the customer.
Once the purchase process is complete, the Customer will receive an email with the information related to the order (order number, products purchased, delivery times, and information on shipping costs).
Contrat et acceptation des commandes
La commande ne sera pas acceptée par nous tant que le montant n’aura pas été débité sur notre compte. En confirmant l’achat, vous recevrez un e-mail de confirmation d’acceptation. Ce n’est qu’à ce moment-là que le contrat entre vous et nous sera formalisé, et uniquement pour les articles mentionnés dans ladite confirmation d’expédition.
Le contrat sera formalisé en langue espagnole et anglaise, si besoin.
Confirmation et annulation des commandes
Avant la finalisation de la commande de votre part sur le site web, vous pourrez revoir tous les détails associés à celle-ci (montants ventilés dans toutes les rubriques nécessaires – taxes, coûts, de transport, sélection d’article, etc.), pouvant corriger ce que vous jugez nécessaire.
Après la confirmation, il ne sera pas possible de modifier ou d’annuler la commande via le site web. Vous devrez nous contacter. Dans ce cas, la commande ne pourra être modifiée ou annulée que si l’article n’est pas entré dans la phase d’expédition depuis nos entrepôt.
Conditions d’expédition
Le territoire sur lequel les commandes sont acceptées et distribuées comprend la Péninsule Ibérique et les Baléares ; des envois sont également effectués à Ceuta, Melilla et aux Îles Canaries. Concernant les envois internationaux, des envois sont réalisés à la fois au sein de l’UE et vers des pays tiers à partir de 20 euros et les retours à partir de 25 euros. Le prix final varie selon la destination (douanes et taxes).
INTERNACIONAL COMERCIO TRADING, S.L. envoie les commandes à ses Clients via différentes entreprises de transport express de prestige national et international reconnu comme SEUR et DHL. Le Client peut connaître à tout moment la situation de sa commande en accédant à son espace personnel.
La livraison sera effectuée à l’adresse indiquée par le Client, qui peut être différente de celle de sa résidence habituelle, pouvant être envoyée à son lieu de travail ou même à une tierce personne à laquelle il souhaite faire un cadeau. Dans tous les cas, l’identification de l’acheteur ou de la personne à laquelle le produit est destiné sera exigée, au moyen d’un document officiel qui l’identifie, et signature du bon de livraison.
Pour les envois vers la péninsule, le délai de livraison estimé est de 1 à 3 jours ouvrables, sans pouvoir dépasser 15 jours ouvrables ; et de 3 à 7 jours dans le reste de l’Espagne. Il est de la responsabilité d’INTERNACIONAL COMERCIO TRADING, S.L d’effectuer les démarches appropriées auprès de l’entreprise de transport pour garantir la livraison de la commande dans un délai maximum de 15 jours ouvrables, sinon l’envoi sera annulé et le montant de la commande et dudit envoi sera remboursé au client. Si après cette période et une fois le montant remboursé au client, l’envoi arrive, le client peut choisir de retourner ledit envoi sans aucun frais ou d’effectuer le paiement de la commande.
Pour les commandes avec adresse de livraison à l’étranger, le délai de livraison estimé est entre 15 et 20 jours ouvrables, sans pouvoir dépasser 40 jours ouvrables. Il est de la responsabilité d’INTERNACIONAL COMERCIO TRADING, S.L d’effectuer les démarches appropriées auprès de l’entreprise de transport pour garantir la livraison de la commande dans un délai maximum de 40 jours ouvrables, sinon l’envoi sera annulé et le montant de la commande et dudit envoi sera remboursé au client. Si après cette période et une fois le montant remboursé au client, l’envoi arrive, le client peut choisir de retourner ledit envoi sans aucun frais ou d’effectuer le paiement de la commande.
Les frais de transport seront gratuits pour tous les achats dans la Péninsule, 12 euros à Ceuta, Melilla et aux Baléares, 20 euros aux Canaries et à partir de 20 euros dans tous les cas pour les envois Internationaux.
Le montant indiqué à la fin, avant de finaliser l’achat, inclura la TVA correspondante. Les îles Canaries, Ceuta et Melilla seront exemptées de ladite TVA. Ces prix sont applicables aux commandes jusqu’à 15 kilogrammes.
La livraison est considérée effectuée à partir du moment où le produit est mis à la disposition du Client par le transporteur et que le destinataire signe la réception de la livraison. Il appartient au destinataire de vérifier les produits à leur réception et d’exposer toutes les réserves et réclamations qui pourraient être justifiées.
Impossibilité de livraison
Si l’entreprise chargée de la livraison de votre colis se présente au lieu de livraison pour la première fois et qu’il lui est impossible d’effectuer la livraison de votre commande, le livreur notifiera ce premier incident et se présentera une deuxième fois à votre domicile avec le colis à livrer dans les jours suivants.
Si la livraison échoue pour la deuxième fois, le livreur notifiera à nouveau l’incident et déposera votre commande au point de collecte SEUR le plus proche de l’adresse indiquée. Vous disposerez alors de 15 jours ouvrables pour aller chercher le colis personnellement.
| Dans le cas où ces 15 jours se seraient écoulés et que vous n’auriez pas récupéré votre commande, celle-ci sera retournée à notre entrepôt et nous procéderons à l’annulation du contrat, en vous remboursant tous les paiements reçus par vous (à l’exception des frais d’expédition encourus) dans un délai maximum de 15 jours à compter de la date à laquelle nous considérons le contrat comme résolu. |
Prix des produits offerts
Les prix peuvent changer à tout moment, mais les changements possibles n’affecteront pas les commandes pour lesquelles nous vous avons déjà envoyé une confirmation de commande.
Le prix des produits offerts sur notre Site Web inclut la Taxe sur la Valeur Ajoutée (TVA) ou d’autres taxes qui pourraient être applicables et sera, dans tous les cas, exprimé en devise Euro (€).
Conformément aux dispositions de l’article 68 de la Loi 37/1992, du 28 décembre, relative à la Taxe sur la Valeur Ajoutée, la livraison des articles sera réputée localisée sur le territoire d’application de la TVA espagnole si l’adresse de livraison est en territoire espagnol, à l’exception des Canaries, de Ceuta et de Melilla. Le taux de TVA applicable sera celui légalement en vigueur à tout moment en fonction de l’article spécifique concerné.

Modes de paiement
Toute commande passée doit être réglée immédiatement après la confirmation de la commande. Seules les commandes dont le paiement a été complété et vérifié seront traitées.
Le Site web offre au Client l’option de choisir entre différentes formes de paiement : carte de crédit, VISA, MasterCard, American Express, ainsi que carte de débit 4B ou 4B Maestro (ce qui implique un débit automatique), PayPal, Paiement en plusieurs fois avec Sequra et Bizum.

Right of withdrawal (or Right of cancellation)
A. General conditions:
You have the right to exercise the withdrawal from your purchase within 14 calendar days following the delivery of the items, unless exceptions provided for in the current consumer regulations apply.
According to consumer regulations, the right of withdrawal will also not apply to contracts that refer to, among other exceptions:
- The supply of goods made according to the consumer’s specifications or clearly personalized.
- The supply of goods that may deteriorate or expire quickly.
- The supply of sealed goods which are not suitable for return for health protection or hygiene reasons and were unsealed after delivery.
- The supply of goods which, after their delivery and given their nature, have become inseparably mixed with other goods.
Withdrawal will imply that you, from the effective possession of the product, have 14 calendar days to notify us of your decision to withdraw from the contract through an unequivocal statement, such as, for example, sending a communication via e-mail to info@henryarroway.com or through the website’s contact form. We will respond within the following 3 business days, with instructions to formalize the return.
We recommend using the following online form. The use of this form does not limit the User’s rights of withdrawal.
Once the 14 calendar day period has ended, returns due to withdrawal will not be accepted.
In case of exercising your right of withdrawal after the items have been delivered, you will be responsible for returning the items to us within 14 business days from their receipt, in their original packaging and original condition, with any related accessories, along with the original invoice, to the following address: INTERNACIONAL COMERCIO TRADING SL, with main offices at P.A.E Asuaran, Edificio Archanda, Pabellón 2B; 48950 ASUA –ERANDIO, VIZCAYA, SPAIN, with NIF B-48753461.
After receiving and checking the returned items, we will refund or credit any amount you have paid or that we have charged to your credit card for the items within a maximum period of 10 days.
INTERNACIONAL COMERCIO TRADING, S.L reserves the right to refuse returns communicated or sent outside the established period, or garments that are not in the same conditions in which they were received; are incomplete, damaged, or dirty.
If the package has already left our distribution center, you must wait for the package to arrive at your address and make a standard return.
B. Returns:
Art. 44 of Law 7/1996, of January 15, on Retail Trade Regulation, grants the Customer the right to revoke the requested order within a period of 20 days from its receipt, subject to prior communication to INTERNACIONAL COMERCIO TRADING, S.L within that period, with the refund of the price paid for it. You may return the purchased item provided that the products have not been opened or used and retain their original seal or packaging. Returns will not be accepted if the product is not sent back in perfect condition, with its original, unused packaging. Returns are free in the Peninsula for all orders. Returns to Ceuta and Melilla are at the buyer’s expense with a cost of 12 euros. Returns to the Balearic Islands are at the buyer’s expense with a cost of 12 euros. Returns to the Canary Islands are at the buyer’s expense with a cost of 20 euros. International returns are at the buyer’s expense with a cost from 25 euros depending on the destination.
C. Returns due to flaws or manufacturing defects:
In case of a manufacturing defect, you may return the purchased item provided that it has not been used and retains its original packaging. Returns will not be accepted if the product is not sent back, with its original, unused packaging.
Furthermore, the entire order must be returned, with all accessories and original packaging of the products. Upon receipt of the product, INTERNACIONAL COMERCIO TRADING, S.L. will examine it and inform you if you are entitled to its replacement. Returns will not proceed for those products that are not in the same conditions in which you received them, or that have been used beyond the mere opening of the product. The return or replacement of the item will be carried out as soon as possible and, in any case, within 10 days following the date on which we send you an email confirming that the return or replacement of the non-conforming item is appropriate.
If at the moment of delivery a clear and visible error in the received merchandise is noticed, without the need to tamper with the shipping or product packaging, the customer must indicate it on the delivery note, and communicate it to INTERNACIONAL COMERCIO TRADING, S.L. by email to the address Henryarroway@henryarroway.com or by phone Customer Service 944396103, within 24 hours following the receipt of the order to be able to request the return of the affected product or products and thus the replacement with the product actually purchased.
In the event that the returned product is out of stock, the Customer may choose to buy another product of similar price and quality or request a refund of the price paid for it.
In these cases, INTERNACIONAL COMERCIO TRADING, S.L. will refund the purchase money, within a period of 30 days from the receipt of the User’s communication requesting the return. This will be done using the same payment method that was used to pay for the purchase, or by bank transfer to the account indicated by the user.
D. Guarantee of purchased products:
The contractual guarantee offered is that established in Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users. INTERNACIONAL COMERCIO TRADING S.L. will be responsible for the lack of conformity that becomes apparent within a period of two years from delivery, provided that the Customer has informed INTERNACIONAL COMERCIO TRADING SL of said lack of conformity within a period of two months from becoming aware of it. In this regard, considering that the Website commercializes products that have a shorter life span than that granted by law for the exercise of legal guarantees, these deadlines will be applied taking into account the nature of the commercialized good.
Events beyond our control (Force Majeure)
INTERNACIONAL COMERCIO TRADING, S.L. is not responsible for the delay or non-fulfillment of any of the assumed obligations due to Force Majeure Events that are beyond our control.
When we talk about Force Majeure Events, we refer, for example, to strikes, war, riot, terrorist attack, fire, storm, floods or other natural disasters, transport strike, acts, legislation or restrictions of government or authorities, etc.
Facing any of these events, obligations will be suspended during the period that the Force Majeure Event continues and INTERNACIONAL COMERCIO TRADING, S.L. will have an extension in the term to fulfill said obligations for a period of time equal to the duration of the Force Majeure Event.
Industrial and intellectual property
All Industrial and Intellectual Property rights for all elements contained in this Website, including trademarks, formats, graphic designs, texts, images, and documents, belong to INTERNACIONAL COMERCIO TRADING, S.L. and are protected by Spanish and international laws on Intellectual and Industrial property. The total or partial reproduction of this Website and any of its contents is expressly prohibited without the express written permission of INTERNACIONAL COMERCIO TRADING, S.L.
Access to the Website does not imply any type of waiver, transmission, license, or assignment of these rights by INTERNACIONAL COMERCIO TRADING, S.L., unless expressly established otherwise.
Viruses, piracy, and other computer attacks
The improper use of this Website through the intentional use of viruses, Trojans, and other programs harmful to the Website or unauthorized access to it or any computer or database owned by INTERNACIONAL COMERCIO TRADING, S.L., could entail penalties for the commission of infractions typified by applicable regulations.

Applicable legislation and jurisdiction

Any controversy that arises or is related to the use of the Website or with said contracts will be subject to the non-exclusive jurisdiction of the Spanish courts and tribunals. Likewise, if a controversy arises from the celebration of this purchase contract between INTERNACIONAL COMERCIO TRADING, S.L and the User, the User as a consumer may request an out-of-court dispute resolution, in accordance with EU Regulation No. 524/2013 of the European Parliament and of the Council, of May 21, 2013, on online dispute resolution for consumer disputes.
